George and Alfred Degiorgio, both in jail for the murder of Daphne Caruana Galizia, as well as the alleged mastermind behind the killing refused to testify Monday in libel proceedings filed by former Prime Minister Joseph Muscat against lawyer Christian Grima.
The Degiorgio brothers, who are serving 40-year prison sentences over their involvement in the Daphne Caruana Galizia murder, declined to respond to any questions before the court.
The court exempted businessman Yorgen Fenech from testifying altogether. Fenech did not want to testify due to ongoing criminal proceedings.
During the same sitting, Keith Schembri presented a sick note signed by doctor Silvio Grixti when summoned to testify.
Schembri was certified as unwell by Grixti on Sunday, the note indicated. Grixti is facing court proceedings in the alleged social benefits scandal.
Lawyer Karl Grech protested with the court on Schembri's absence.
Magistrate Victor George Axiak said that the court would decide after hearing what the doctor had to say about this.
Muscat was also not present, with his lawyer Pawlu Lia informing the court that the former Prime Minister was abroad and apologising for his absence.
Grima's lawyer said Muscat should have filed a court application ahead of time to justify his absence.
Chris Cardona, Muscat's former economy minister, also did not attend the sitting. He filed a court application, which included copies of his flight tickets, to excuse himself.
That was the correct procedure, the magistrate told Muscat's lawyer.
