A US lawyer suing mob boss Daniel Kinahan says he’s one step away from victory - after a judge said his client should be awarded $9.5M.

Last week US Magistrate Judge Stephanie Christensen issued a major ruling formally recommending that the District Court in California grant a default judgement - and award Moses Heredia $9,517,500 in damages against Kinahan, former boxing company MTK Global, and Paul Gibson.

Judge Christensen made the recommendation that boxing manager Mr Heredia, who is being represented by top US lawyer Eric Montalvo, be paid the sum by Kinahan and the others, who he’d alleged had poached his fighter JoJo Diaz.

The recommendation comes after Kinahan, MTK and Gibson all failed to mount a defence in the case, which has gone on for over four years. And while the recommendation is a major victory and a knockout blow for Kinahan, the presiding Judge in the case, John W. Holcumb must now consider it, before making the final decision.

Speaking exclusively to this paper, Eric Montalvo, who says his clients ultimately hope to give some of the money to the families of innocent victims of the Kinahan cartel, said he’s hopeful that victory is now finally in sight. “I think that we’re getting closer to the end of this journey and we’re pleased to see the judge did a very detailed and thoughtful analysis of what we submitted.

“It’s vindication of the harm that was put on the Heredias by the Kinahans,” he told us. “God willing, the judge enters the final judgement and then we’re going to seek the financial justice that the Heredias deserve and then circle back to try and get some of that money to those families who suffered at the hands of the Kinahans.”

Previously the Heredia family have vowed to utilise some of the money they hope to recover from Kinahan to help families of innocent victims who were brutally murdered at the hands of the ruthless cartel. As this paper reported, Mr Montalvo even jetted into Ireland and met some of those families - including the father of slain Kinahan cartel victim Michael Barr.

Republican Barr was shot and killed in the Sunset House pub in Dublin’s inner city by the Kinahan cartel - after he was wrongly accused of being one of the shooters in the Regency Hotel murder of David Byrne. The Kinahans are also responsible for the horrific murders of innocent Dublin city council worker Trevor O’Neill, homeless man Martin O’Rourke, and Dad-of-two Noel ‘Duck Egg’ Kirwan.

The major development in this case comes as the Kinahans are now facing the heat from multiple different fronts. Here at home Gardai are now awaiting an impending decision by the Director of Public Prosecutions in relation to a comprehensive file sent on the Kinahans.

Gardai want to charge Daniel Kinahan with the murder of Eddie Hutch - and await a decision by the DPP on that matter. In the meantime Minister for Justice Helen McEntee is attempting to broker a form of extradition treaty with the United Arab Emirates - as hopes grow that the Kinahans could be deported back to Ireland.

The Kinahans are still also the subject of crippling sanctions imposed by the United States government this time two years ago.
The DEA and US Department of Treasury issued a staggering $15M reward for information that could lead to the prosecution of the Kinahan cartel leadership at that time.
