Minister Speaks Up for More Transparent Standards in Rule of Law Procedures

The Minister of EU affairs highlighted a shared consensus among member states regarding the necessity for clearer and more transparent standards in the rule of law conditionality procedure. He emphasized the need to adapt procedures and methodologies accordingly.
Attending an informal meeting of his foreign counterparts in Brussels, János Bóka, stated during a press conference that ministers supported Hungary’s proposal, previously raised multiple times, advocating for structured dialogues between the Court of Justice of the European Union and the constitutional courts of member states regarding general rule of law standards. Minister Bóka underlined that rule of law standards are developed at the member state level and must be upheld by the EU and its institutions.
Moreover, he emphasized that the EU possesses adequate tools within the current framework to address issues related to EU values, including the rule of law.
Member states showed openness to expand the dialogue on the rule of law to encompass other areas, although concerns were raised regarding the potential for EU scrutiny of election campaigns or political discourse, which might verge on censorship. Additionally, member states reached a consensus against making membership of the European Public Prosecutor’s Office compulsory, recognizing the value of voluntary participation.
It was also agreed that the EU lacks general competence to protect its fundamental values.
Regarding EU enlargement, ministers expressed support for involving countries furthest along in the accession process, such as Serbia, Albania, Montenegro, and North Macedonia, in the rule of law dialogue. There is hope for an agreement on this during the Belgian EU Presidency, with Hungary aiming to initiate the dialogue during its upcoming presidency, emphasizing voluntary participation on an equal basis without hindering the accession process.
Looking ahead, János Bóka mentioned that leaders of member states will adopt a roadmap for EU enlargement during the next summit.
He stressed that during Hungary’s EU Presidency, starting in July, discussions will prioritize the most crucial EU policies,
followed by budgetary implications and institutional procedures, with a focus on strengthening EU competitiveness.
In addition, Minister Bóka held discussions with the secretary-general of the European Parliament to prepare for Hungary’s presidency, emphasizing the importance of fair institutional cooperation to ensure a smooth transition.
